Enhance transparency, accountability of and access to the judiciary system

Project Description
The Project Enhance transparency, accountability of and access to the judiciary system seeks to enhance transparency, accountability of and access to the judiciary system in the Republic of Moldova. Component 1 concerns the development of a Court monitoring methodology and subsequent monitoring carried out in the targeted areas. It will be followed by data analysis that will describe the resulting impediments to access to efficient justice and allow the development of empirically based recommendations. This, in turn, should ensure that the court monitoring will reveal shortcomings of access to justice and fair trial rights and to inform future reform policy. Component 2 focuses on the capacity building of lawyers, including young / future lawyers, and further development of legal aid system to ensure that all citizens enjoy effective access to justice and fair trial rights. This Component will combine strategic advice, legal and policy drafting, mentoring, guidelines, training material, as well as tailored-made capacity building, based on the best European practices. Component 3 will include (if condition allow) activities aimed to support design and implementation of the selected elements of the judicial reform and address shortcomings identified through court monitoring.
Specific Objective
1. To reveal shortcomings of access to justice and fair trial rights and to inform future reform policy.
2. To increase capacity of lawyers to ensure improvement of trial rights and the provision of legal aid.
3. To support design and implementation of selected elements of the judicial reform and address shortcomings identified through court monitoring, if conditions allow and additional financing is allocated.
Expected Results
Component 1: Development of court hearing monitoring methodology; Conducting monitoring of court hearings; Development of the Report on monitoring of court hearings (data analysis, findings and recommendations).
Component 2: Strengthening the mechanisms of admission to the lawyer’s profession, functioning and transparency of the Licensing Commission of Moldovan Bar Association; Strengthening capacities of the Lawyers Training Centre; Training of trainers of the Lawyers Training Centre; Setting standards for professional traineeship; Establishing a mentorship program with the Lawyers Training Centre; Development of the mechanism of the partially financed State Legal Aid; Organizing support lectures of reputable law professors of EU MS on subjects related to access to justice, fair trial rights and other relevant legal areas.
